Fausett v. Walgreen Co.

Plaintiff, individually and on behalf of others similarly situated, brought an action against the defendant alleging that it willfully violated the Fair and Accurate Credit Transactions Act by printing more than the last five digits of debit card numbers on receipts provided to consumers. The trial court granted the plaintiff’s motion for class certification and defendant appealed, arguing that the plaintiff lacked standing to bring her FACTA claim in Illinois. The appellate court affirmed, holding that under the principles of standing in Illinois, an alleged violation of an individual’s rights under FACTA is sufficient to confer standing even in the absence of an allegation of any actual injury or adverse effect.
