2011 veto session legislation By William A. Price Administrative Law, January 2012 The Illinois General Assembly passed a companion bill and primary bill HB3851, which, with House Amendment No. 1, allowed the City of Chicago to use cameras to produce issuance of tickets for speeding. The Administrative Law Section Council commented adversely on same, suggesting full funding for Secretary of State hearings functions, and making some due process suggestions for fairer administrative case resolution under the new law. These comments were sent to ISBA staff and the Committee on Legislation for further discussion and action as appropriate. ■
Illinois Supreme Court Rule adds unauthorized practice of law to the Attorney Registration and Disciplinary Commission’s responsibilities By William A. Price Administrative Law, January 2012 The Illinois Supreme Court has adopted amendments to its rules of practice (751 and 752(a) and 779, effective December 7, 2011. The new rules allow investigation and prosecution by the Attorney Registration and Disciplinary Commission of instances of unauthorized practice of law by disbarred or unregistered lawyers, and by other persons and organizations.
New Illinois Tax Tribunal authorized By William A. Price Administrative Law, January 2012 The General Assembly took some time for administrative law and other matters when passing the Sears and CME tax breaks. Public Act 097-636 creates an Independent Tax Tribunal Board as of July 1, 2103, to hear protests of notices of tax liability and notices of deficiency for all taxes administered by the Illinois Department of Revenue.
