Legislation
The Section Council reviewed 80 bills that may affect their members’ practice area. Highlights of the most recent legislative session include:
- Senate Bill 47 upgrades the Transfer on Death Instrument Act.
- Senate Bill 2664 amends the Illinois Notary Public Act providing requirements authorizing electronic and remote notarization and electronic notaries public.
- House Bill 58 creates a process for property owners and community associations to modify an “unlawful restrictive covenant” with the local recorder. It is defined as any recorded covenant or restriction that is void under the Illinois Human Rights Act.
